Standard Commercial Mortgage Insurance Requirements
Lenders cannot fund commercial mortgages based on standard ACORD 25 certificates of liability insurance alone. For property damage, lenders require the ACORD 28 "Evidence of Commercial Property Insurance," which grants contractual rights to the mortgagee.
Underwriters review insurance binders to verify that key policy standards are satisfied prior to closing:
Core Property Coverage Mandates
- 100% Replacement Cost Value (RCV): Must have no co-insurance penalty clause or an Agreed Value endorsement.
- Business Interruption & Loss of Rents: Must cover ongoing operating expenses and debt service for a minimum of 12 to 18 months.
- Ordinance or Law Coverage: Protects against the cost of upgrading undamaged structures to comply with current municipal building codes following a partial casualty loss.
- Flood Insurance: Mandatory if the property touches a FEMA Special Flood Hazard Area (100-year flood zone).
- Wind / Named Storm / Hail: In coastal or storm-prone corridors, windstorm deductibles are typically capped at 2% to 5% of insured value.
